These general conditions of sale (hereafter “Conditions”) apply to all orders placed by the Internet user (hereafter “the Customer”) on the website yadayada.ch
Article 1: Acceptance of Conditions and Modifications
These Conditions can be read directly on the website yadayada.ch. Upon Customer's request, they can also be sent by email.
Checking “I agree to the terms and conditions” before proceeding to secure payment constitutes an irrevocable act and the Customer acknowledges that he has read and understood these conditions and accepts them. YadaYada reserves the right to modify at any time these terms and conditions.
It is the Customer’s obligation to regularly consult the content of the present Conditions, either on the website yadayada.ch
Article 2: Purpose
These Conditions are intended to define the entire rights and obligations of the parties in connection with the online sale of goods and services offered by the website YadaYada.ch to the Customer, to the order to delivery, through the payment and the using services provided by YadaYada.
Article 3: Scope
These Terms govern the sale of products on the day of ordering by the customer.
Article 4: Order
4.1. Any Customer states to have the capacity to contract. YadaYada reserves the right to refuse any order from a Customer with whom there is or would appear during processing of an Order of litigation, in particular a payment dispute.
Customer can place an order with YadaYada by Internet 24h/24h.
Once the payment method selected, the Customer must make payment of his order on the secure interface, which will formalize a firm and definitive sales contract which binds him to YadaYada.
Any order implies acceptance of the prices and descriptions of products available for sale.
4.3. Order Confirmation
An email is automatically sent to the client to confirm the order is taken subject to the email address listed on the registration form does not error.

4.4. Order Status

YadaYada cannot be held responsible for outages or errors that may affect the information provided by its transport.
Article 5: Product Information
5.1. Product features
Products sold on YadaYada are described on the website at the time of the sell. The information, specifications and photographs displayed on the site are only indicative and are mostly donated by suppliers and cannot incur liability YadaYada. YadaYada will do its best to ensure that the photographic representation of the products on the site is as accurate as possible.
5.2. Product Availability
YadaYada undertakes to fulfill orders received within the limit of available stocks of goods or the limit of stocks available from its suppliers. Availability may vary within the same day depending on the level of sales. YadaYada performs an update available very frequently, but cannot be held responsible if the stock is no longer the same as shown.
If one or some products are not available, YadaYada pledges to inform the Customer as quickly as possible.
Article 6: Prices
Prices are in CHF including VAT and are applicable only to the date of sending confirmation of the order by the Customer.
Prices can only be mentioned in Euros.
Prices do not include delivery charges, any promotional offers and discounts personal, indicated before the final confirmation of the order.
The prices listed on the site can change at any time. However the prices cannot be changed once the customer order placed. Order deliver outside of Switzerland cannot be subject to Swiss VAT but could be subject to potential taxes and custom duties. These costs are the responsibility of the Customer.
Article 7: Payment
7.1. Payment methods
Customer may set the order online by credit card: Visa, Eurocard-Mastercard and Postcard or by e-Finance. The Customer warrants to the Company that it has YadaYada the required permission to use the payment method chosen by him, during the validation of the order. The flow of purchases on the customer's account is done at the time of order processing.
YadaYada implements all necessary means to ensure the security and confidentiality of data transmitted online. To this end, the site uses a secure mode of payment SSL (Secure Socket Layer) which allows encryption of your information during transmission over the network.
YadaYada reserves the right to suspend any order and the delivery in case of refusal to authorize payment by credit card by certified financial institution or in case of nonpayment.

The invoice will be available in the online tracking of orders of the Customer's account.
7.3. Transfer of Ownership
YadaYada retains ownership of the Products shipped until full payment by the Customer. The above provisions do not preclude, upon delivery of the Products, the Customer transfer risk of loss or damage to products subject to reservation of ownership and the damage they could cause.
Article 8: Delivery
8.1. The products are delivered to the address indicated by Customer on the order form.
8.2. Delivery areas
We deliver everywhere in Switzerland and worlwide.
8.3. Delivery Services
The Customer must verify the completeness and compliance information provided to YadaYada which cannot be held responsible for any data entry errors and the consequences in terms of delays or misdelivery. In this context, all costs incurred for the return of the order will be fully borne by the Customer.
8.4. Shipping time
Orders placed online through the site are recorded every day from Monday to Friday, except holiday. YadaYada makes every effort to process and ship orders the same day before 2 pm, however, processing time and prepare an order may be extended depending on the items and take between 1 and 2 days. Upon receipt of the email confirmation of shipment, the Customer may take into account the time of the carriers announced below, taking into account that shipping times do not include Sundays and holidays.
Delivery times depend on the carrier chosen by Customer and place of delivery.

** The delivery period should be counted once the package has been dispatched. All the orders placed before 16 o’clock will be shipped, if possible, the same day, unless the products are out of stock. In case of bike delivery, the shipment can be done the same-day, in 2 hours and applys to all orders placed from 8 to 16 o’clock.
8.5. Gift wrap
YadaYada offers its customers a free gift wrapping service for non-bulky items such as clothing and accessories, small toys and small decorative objects.
8.6. Customer's responsibility to check the parcels at reception
YadaYada recalls that it is Customer's responsibility to inspect packages for its reception in the presence of the deliveryman and report any anomalies (shock, damage of the package, delivery date does not conform to normal periods of service delivery ...) the carrier, and YadaYada within two business days. Where such references were not given on the delivery note presented to the Customer by the carrier, surrender is no claim.
8.7. Delivery delays due to the carrier
In the case of late delivery compared to the time indicated by the carrier, the Customer must first contact the carrier or the Post Office to see if the package is pending.
The Customer must check before the carrier status of the package and any reservations on the delivery slip for damage or partial. Without reservation, the product is deemed accepted by Customer and will be no dispute about its delivery.
Article 9: Right of withdrawal, return and exchange
Customer can at its charge returns its delivery within 7 business days from the delivery. The return request may be made by contacting Customer Service YadaYada by email or telephone that tells the client how to proceed.
The Customer Service pledges to respond to a return request in 24 hours by informing the Customer of the return procedure.
Returns must be intact, in perfect condition for resale in their original packaging. It should not have been worn or used, or have suffered damage as minimal as it and in a state of cleanliness. Any product that is damaged, incomplete, or whose original packaging is damaged, will be refunded or exchanged.
The products returned in accordance with the above paragraphs could be, at the Customer’s choice, reimbursed or exchanged. In case of reimbursement, YadaYada would do its best to reimburse the Customer over a 30-day period.
Any promotional item, pay or sold with a promotional code will not be refunded but will be if the Customer wants exchanged.
Article 10: Pledge on privacy
10.1. YadaYada does not collect and process Data except when voluntarily provided by you.
10.2. YadaYada collects and processes Data only for to provide you with our products or services, to bill you for products or services you request, to verify your credit, to receive news releases, or to communicate with you. In addition, we may use your Data for our own internal statistics to evaluate customer interests as well as purchasing.
10.3. YadaYada shall never sell, rent, share or otherwise distribute or make available your Data to third parties outside of YadaYada, except when required to do so for legal or regulatory purposes.
10.4. Right of access
The Customer have the right to access and update his Data or to require their deletion.
10.5. Security / Confidentiality
YadaYada undertake to take all reasonable steps in order not to allow your Data to be seen by third parties other than those who act for or on behalf of YadaYada and have agreed to treat your Data confidential and secure. Access to Data is restricted to those of our employees on a need to know basis and who have been trained to observe strict standards of confidentiality in handling your Data.
Article 11: Intellectual Property
All content (texts, commentaries, articles, illustrations, pictures, videos, graphics, sound ... including the underlying technologies used) displayed on this site is under copyright and that under intellectual property and for the world. For this reason and in accordance with the Code of Intellectual Property, only use for private use is permitted, subject to different rules even more restrictive trictives code of intellectual property. Any other use constitutes infringement and is punishable under the Intellectual Property without prior authorization YadaYada.
Article 12: Limitation of Liability

YOU RECOGNISE AND ACCEPT THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE REGULATIONS, NEITHER YadaYada NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE WEBSITES, MAY BE HELD LIABLE FOR ANY DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES, ANY INJURY TO REPUTATION, COSTS, LOSSES, DECREASE IN TURNOVER OR PROFITS OR LIABILITIES OF ANY NATURE WHATSOEVER, CAPABLE OF ARISING FROM YOUR ACCESS TO, OR USE OF, OR ON THE CONTRARY THE IMPOSSIBILITY TO USE, THE WEBSITES OR THEIR CONTENT.

Article 13: Applicable Law and jurisdiction
The business relation between YadaYada and the Customer are regulated by the Swiss Law.
For any litigation between YadaYada and the customer, the applicable jurisdiction is the one of the location of the headquarters of YadaYada in Geneva.
